I have an agency employee who has tested positive. The employer is requesting a copy of the chain of custody to submit to the regulatory agency. Can I release that information without some type of release from the employee?

    Who paid for the drug test? If employer paid, then the test information belongs to the employer, and they need it to continue the process they have established for personnel "negative and positive actions"! In our case I already have the signed release documentation and I only need the actual drug testing documentation to insure the protocal is in order; in the case of a negative result, we move forward with positive personnel actions; in the case of a positive result, we move forward with negative personnel actions.
