layoffs

I am aware of the WARN Act that applies when you have a large layoff or a plant closing but does anyone know if there are any Massachusetts laws or statutes that I need to be aware of when you have a small layoff say 5-10 ee? Do we need to give 30 day notices, etc.?

I apprciate your input.

  • There is a Massachusetts WARN Act. Here's a brief quote from our Massachusetts newsletter:

    In addition, a mass layoff or plant closing may trigger obligations under the Massachusetts version of WARN. Mass. Gen. L. Ch. 175 Sec. 110D applies in certain circumstances and requires you to maintain an employee's medical benefits for up to 90 days after layoff. For additional details on your obligations under either the Massachusetts or federal WARN Act, contact your labor and employment counsel.

  • Would the WARN Act apply to only 5 or 6 layoffs? Our health census is low and we will need to layoff only 5-6 people until the census gets better.
