Employee almost comes to work under the influence

I need some suggestions on this one. I had an employee call off 1/2 hour after her shift was to start. At my company this is considered a no call no show and will result in a warning letter. I read the paper the next day and discovered this employee was picked up for operating while intoxicated that day 10 minutes prior to her start time. So, the story looks at though she was on her way to work (allegedly under the influence) and was stopped by the police and never made it in. My concern is if she had never been stopped, she would have been at work under the influence. Is there anything I can do or say about this?

I don't think there is anything you can do other than follow your policy regarding her failure to call in as well as whatever attendance policy you have. She did not come in to work under the influence so there isn't anything you can do regarding "fitness for duty".

I would have no problem explaining to her your perception of the events, and making sure she fully understands the policy - one of those "for future reference..." talks.
