I have an employee who is always trying to get around the the rules and procedures. At times it has put our office in a bad situation, with complanits and made our office look stupid. I have tried talking to the employee. I have done conunsling, written warnings, moving their office to a more exposed area and I sent them home with out pay for 3 days. The rumors I hear from other employees is,the rule bender is out to get us. The employee blames all their problems on others and dosn't understand why they are being singled out. This employee is very capable in their job, but keeps doing things that are not allowed in the office. What can I do to resolve this?

IF.....I say if you've documented the process you described in your post, it sounds as if the only thing left is termination.

I agree with Crout. If you have done everything to warn the person to no avail termination is the next step. Plus if you do not terminate the other employees who follow the rules will feel that it is okay to bend them. Whatever you do remember you are going to set a precedent.

Sounds like by terminating this person you have the opoportunity to significantly increase morale!

Cut this person loose at the first opportunity and soon - since you have documentation.

You are spending way too much time with this employee who is spending way too much of his/her time on bending rules.

Once in a while a termination can be a good thing for a company.

Anyone who has been suspended for three days and still doesn't change their ways, never will. The time has come to terminate.

I would guess that when you counseled and wrote warnings, you explained the specific behavior that must change and what will happen if it doesn't. If you did that, just do what you said. If not, sit down one last time, talk about the specific behavior that must change. When they give excuses, let them bounce off and redirect to the specific behavior that must change. Get their agreement to change and let them know that this is their last chance. If they don't change, terminate.

I vote terminate. You cannot let one bad apple spoil the bunch! Then the employee can go bend rules some where else.
