Rules for Evals

Can someone tell me if there are laws or unwritten rules regarding giving an employee a copy of a performance evaluation? I am in California Land , the land of exceptions and constant changes.

We always give copies if they are requested as well.

We offer a copy at the time of the evaluation. I think employees shouldn't be surprised by what is in their file.

We instruct the Supervisors to give every EE a copy of their evaluation.

Our Department Directors always give copies of the performance evaluation to employees. That way they can see the areas they are weak in and need to work on. Also, the feedback on the evaluation form is helpful to the employee.

Much like the others who've replied here, we also offer a copy of the evaluation [u]upon request[/u]. The employee and supervisor meet in confidence to discuss every detail on the review. However, we don't automatically make copies for every employee because, let's face it, employee talk. It'll only stir up trouble and feelings of resentment if Joe Employee finds out Mike Supervisor gave John Employee a higher score in Teamwork, Productivity or whichever category.

Your basic question was, is there a law..........The answer is No. The wisdom of it is another question.

I think there is a code that covers this - you might check Section 432 - the legal reference we use (and our company policy supports) states that employees do not have an absolute right to copy all personnel records, but DO have a right to copies of any document s/he has signed, which usually includes their application, disciplinary notices and evals, IF you require your ee to sign the eval.
