Paternity Leave

An employee asked me what kind of paid paternity leave we offered. I said none. I told him if he wanted the time off, it would have to be unpaid under FMLA. He told me it was the law that companies offer paid paternity leave. I just wanted to make sure that this is not true.

There is no federal law that requires paid maternity leave.

But you need to check your state laws to see if there is a requirement.

The ee might be confused with California's new paid leave law. It was just passed recently, but it doesn't take effect until Jan 2004 and payouts for it won't be until July 2004. Or maybe he's from Europe where paid paternity leave is very common.

In Texas we offer no paid paternity leave. Our research did not reveal any Texas statute which required paid paternity leave. We do allow employees to use their sick leave days and vacation days if they wish, for paternity matters. Any days not included in sick leave or vacation are considered an excused personal leave without pay. Wish you well with your situation.

I am not surprised at CA having a paid paternity leave, they have a habit of setting a pace that no one else wants to nor needs to follow! FMLA yes, if they other wise qualify. Pork
