Is it OK to ask what restrictions a person has on a CDL license and is it legal to ask some to explain why they cannot perform the essential functions of the job?
What I do is, if it is an essential function of the job to have such a license, I ask that the employee submit a copy of their driving record from the Department of Motor Vehicles.
As far as essential functions of the job, I show the candidate a copy of the essential functions of the job (via job description) and ask if there is any reason they cannot perform the essential functions of the position as stated.
