Vacation and sick leave

When someone is taking unpaid sick leave, can we require that they use their paid vacation time? Our PTO policy is that you must use your accrued PTO days before using unpaid leave, and we are wondering if we can apply the same to paid vacation and unpaid sick leave.

We are in WV if that helps.

Write your policy so as to provide maximum benefit to the company. And follow it to the letter. Setting up the series in which people must take leave and requiring them to exhaust one before going on the other, would violate no federal regulations. Don't know about WV.
