Handbook

Another handbook question - do we have to put something in about equal pay and employment of relatives or can we just address issues as they arise? Also is a small company required to give access to personnel files to employees if they ask?

  • I'm not sure how to handle your handbook question, as far as I know, you can put (or not) anything you want in your handbook so long as it legal.

As for viewing personnel files, the following is from the Minnesota Department of Labor and Industry website:

Minnesota employers are required to provide employees with access to their personnel record upon written request. An employee is entitled to review his or her personnel record once every six months. A former employee may obtain a copy of his or her personnel file free of charge within one year of termination of employment (see Minnesota Statutes 181.961).

You might want to take a look at the actual statute, but as far as I know, there is no exeption due to number of employees.
