HIPAA Privacy - HELP

The Privacy regs for HIPAA go into effect in April and I am trying to determine if my company needs to comply. We offer 3 medical plans - fully insured commercial products - no self insurance of any type.

I have been told unless we are defined as a health plan or we self insure our plans, that we don't need to comply. Can anyone offer some guidance?

Much will depend on the actual dollars that are expended in the plans you offer. Seriously, you may want to get a local personnel law attorney to advise you as the consequences could have a significant financial impact on your organization. Just a thought.
