Cell Phone response if not on clock

If a company (10 employees) gives to employees a cell phone for them to use (and take home with them over the weekend), can he ask employees to voluntarily answer a call if it comes in when they are not on the clock? These are hourly employees with some having very specific knowledge as to vending game repairs. For instance, someone worked Mon-Fri & got a call fri nite around 8PM from a co-worker who was on call about a machine & was out & left his cell phone at home (he was not working). Since then, owner of company wants to ask all employees for a list of who may be called at home or while not working to field some questions. My initial thought is that they would have to somehow document each call and be paid when they are called.

  • Have you ever thought about having specific people on "On Call Duty?" You could then only call those on the list at that time. We have employees like this in our MIS department. They take turn being on call for a full week. They are then paid a minimum amount (1 hour)even if the job takes 5 minutes. They then have an incentive to answer the phone during non-working time.
