In Ohio:
What documents, from the employee's file, does an ex-employee have the right to review, and which ones does he have the right to copy?

  • fabe: I noticed you've gotten no responses from your state. Maybe a local area employment law attorney is your best bet. In MS, neither an employee nor an ex-employee has a legal right to see or have anything from their file in the absence of a subpoena. Some might say, "Well it's MY file!" Actually it's the company's file. Many will suggest we should give them what they want to fend off a potential legal action. Some states have statutes allowing employees access to their own personnel records.
  • MN law allows an ex-employee a copy of everything contained in the employee file within one year of termination. You might want to check with your state's DOL. I accessed the MN State statute through the MN DOL website. x:D
