Help Please!!

I had a situation where one of our California employees was terminated. In our company we pay out any unused vacation. This particular employee did not have any. Somehow he was still paid for 60+ hours of vacation! When I questioned this I was told that that's the law in California. He wasn't even employed with us for a year and he still came out ahead. Is there somewhere that this law is documented.

  • [font size="1" color="#FF0000"]LAST EDITED ON 07-01-02 AT 01:34PM (CST)[/font][p]Under California law, Labor Code 227.3, an employee is entitled to pay out of any accrued vacation time at time of termination, even if he or she wasn't eligible to take it at that point.

    So, if your vacation policy has employees accruing vacation during their first year but not entitled to take it until after the ned of the first year, then, if and when an employee is terminated before the end of the first year, he or she is entitled to the accrued vacation time earned up to that point.
