Driving to work restriction

I have an employee who has had seizures and is therefore restricted to not driving for 6 months. We have positions in the plant for this employeee to do but he is claiming he cannot come to work because he cannot drive. The ability to drive ios not a requirement of the job, just the ability to get to the worksite. Is there anything in Federal or Florida law which says we must allow this employee to stay out of work due to a driving restriction.

  • Very interesting question. Not federal law. Maybe Florida, but I doubt it. One must meet the job's requirements, one of which is being at work, in order to be a qualified individual. And it's not reasonable to expect the employer to provide transportation. This is one the current congress hasn't thought of yet. Keep us posted.
