Can I refuse to promote a employee into a position in which her husband is employed if she is not directly reporting to him? We have other situations in other departments in which non direct report family members work together. In this case, it would be detrimental. Does Delaware have a specific marital status law that would prevent this?

It would depend on your policy if you have one about this; otherwise, you probably need to go on what precedent you have set unless there is a legitimate business reason why these two should not work in the same department.

We don't prohibit relatives from working together unless there is a reporting relationship, directly or indirectly. Or....unless there is a good business reason for them not working together.

I don't know of any state that has "marital discrimination".
