Basic FMLA Question

I have what I believe is a basic FMLA question. I am in the process of entering in FMLA times taken by our employees into our Payroll/HR computer system. When you are counting FMLA days, do you count them based on a 5 day work week or a total amount of days out? Thanks for your help!

  • Depends. If an employee states that are going to take the full 12 weeks which is typically the case in a pregnancy situation, I count 12 weeks. But...you can count by days which would be 60 or it can even be broken down further in hours which would be 480 in the case of intermittent leave.
