Drug testing in Arizona

Can anyone tell me whether or not random drug testing is allowed in Arizona? This would not necessarily be for security or otherwise sensitive positions. I've spent almost an hour researching on-line and can't seem to find a definitive answer. Thanks.

If the drug testing is a pre-employemnt requirement. We msut test all employes across the board .RIGHT?? Can we grandfather the old employees? What about background checks? I am in AZ.

We do pre-employment, random, general, post-accident, etc...the whole nine yards. If you start pre-employment testing you have to test every new hire - can't pick and choose. It sounds like you've never had a program at all. Ours has been in place since before I got here, so don't know what kind of notice you would need to give your present employees if you chose to implement a random testing procedure. We have also always done background checks - all we do with job postings is notify any applicant that they are required to submit to a background check if they are hired.

Thank you Leslie. I just moved from the East Coast to AZ. In my last company we did drug and background test. This new employer does not. I am trying to make them see how important this is to an organization. I am not an expert on AZ law yet. I just wanted to confirm if we do background checks and drug test we MUST do it acroos the board for old and new employees.
