Hiring Non-citizens

Am I required by the Department of Labor (or any law) to hire a qualified US citizen over a qualified non-citizen (i.e. an individual with a work visa, green card, etc. who otherwise meets the job requirements)?

  • No. My understanding is that you should NOT base hiring decisions on citizenship. The federal Immigration Reform and Control Act prohibits discrimination based on citizenship. Title VII prohibits discrimination based on national origin, which is a little different. Good luck.
