Freedom of Information Act

Our agency is a "public body" under the Freedom of Inforamtion Act. We have an internal investigations committee approved by the Board of Directos and made up of a representative from HR, Legal and Risk Management. The sole purpose of this committee is to investigate sexual harrassment and workplace violence complaints and incidents.

Are employee statements and other information compiled during the preliminary investigations subject to disclosure under the Freedom of Information Act? ie investigation tapes of interviews with all parties. The committee is concerned disclosure of some of this information (to employees requesting the information, whether involved or not) will discourage other employees from coming forth and engaging in open/honest communications with the committee. Can we apply FOIA 15.243: Items exempt from disclosure to this situation?
