Pay Periods

I know of no federal requirement regarding pay periods...i.e. must be bi weekly or monthly. Is this correct? Our problem specifically deals with part time employees. Thanks.

  • There's no federal law that sets out how often or in what form employers must pay wages to employees. Most states have specific requirements on the timing of paydays and payment upon termination. Some states regulate frequency requirements for paychecks and state the length of time that may elapse between the end of the pay period and the actual payday. My state requires that public corporations and manufacturers with 50 or more Ee's pay at least twice each month or every other week or on the second and fourth Saturdays and within ten days of the end of the pay period. Typically in our state, salaried Ee's are paid every two weeks or either twice a month and hourly workers are paid every Friday. If you have a state DOL, they can advise. If not, your Employment Security Office can.
