Vacation pay help

I have an employee who has been put on Involuntary leave of absence since 2/22/02 due to the lack of work at our facility. His 3 year anniversary was 3/5/02. We have planned to ask him to return to work but he has eluded to his co-workers that he will come back only to terminate his employment and receive his vacation pay. My question is, doesn't he have to be back from the leave of absence a certain amount of time before he can get his vacation? or did he still earn that time while he was out on leave. I have heard so many different scenarios and I am stuck!
