AIDS

We have an employee who has told us he has AIDS. Only a few of his co-workers know. He has refused to voluntarily tell his co-workers. Do we have a duty to tell them?

  • No. In fact, you probably have a duty not to tell them about this co-workers medical condition. The co-worker has a right to privacy in medical information.

    If some special circumstances exist regarding the job (for example the job involves some type of invasive procedures or has a high risk for exchange of bodily fluids [although I can't think of one off of my head]), you may want to address the issue. But before you do so, you need to seek legal counsel.

    On other thing you could consider doing is to give all employees some type of general first aid training that covers blood born pathogens. That would not single out this employee, would not involve the company breaching his right to keep his medical information private, and may make you feel more comfortable.

  • By telling the co-workers that the employee has AIDS you are only setting yourself up for a lawsuit. You can't give out medical information on any employee.
