Workers' Comp

An employee who has chosen to attend a chiropractor has had his appointments scheduled during working hours. Is the company responsible for paying his wage while he is at the doctors office? The only thing I can find regarding any type of compensation has to do with the three consecutive days off clause. Please advise.

  • I think many employers offer sick pay to employees who need time off to receive medical care for w/comp injuries. Prohibiting the employee from doing this generally stretches the absence long enough to receive indemnity paymnets via w/comp, so you may actually lose by preventing time off with pay.

Your state determines whether partial day's absences are eligible for lost time payments from w/comp. The states I'm familiar with pay w/comp lost time payments for either an entire day's absence or more than 1/2 of the scheduled work day. Your comp carrier s/b the one to help you with this question.
