On site exercise room

We're building a new facility which will include an exercise room for employee's use.
What should we be concerned about in terms of potential liability?

  • We are a cardiology practice and we are lucky enough to be able to use the rehab exercise facility for employee use. However, there is a certain amount of liability. To counteract this, our employees who wish to use this facility are required to be assessed just like the patients before they undertake an exercise program. At the very least, you should have employees complete an assessment of their present health and have a physician sign off on it. Otherwise, you may be opening yourself up for liability if something happens to an employee while exercising on site.
  • an issue that may come up is whether your workers comp insurance covers an injury...the idea is that it is an injury incurred in the course of their work because a fit employee is a productive employee...check with your carrier,and check with your general liability carrier as well...regards from texas,mike maslanka
  • We have a small exercise facility and have all employees sign a Waiver & Release Form (including Workers' Compensation Benefits) if they are injured while participating in voluntary recreational or fitness activities on company property. No one has questioned it and they are happy to sign it because they appreciate the perks the company offers. So far no one has challenged this.
