Pregnancy Act

We have an employee that has requested minor modification to her job assignment due to her pregnancy. There are no specific health problems. We are certainly able to accomodate her request and have done so. My question is; Can we require her to obtain a medical certification from her health care provider stating her work status.

  • The federal Pregnancy Discrimination Act essentially requires that you treat the pregnant employee in the same manner as you would any other temporarily disabled employee. If you would require a temporarily disabled employee to modify work duties without doctor's verification then, you would need to so for this employee. If you require a temporarily disabled employee to obtain a doctor's statement identifying the need for modified duties due to the medical condition, then you should get a similar statement from the pregnant employee's doctor. Check out your state law on any pregnant employee rights.
