I am researching whether employers can ask an applicant's sex and race during the application process for recordkeeping reasons so long as this information is not considered in the hiring process. I assume an employer can ask new hires if the employer is subject to EEO-1 reporting but not subject to an affirmative action plan. Does anyone have any forms that are used for this purpose? Thank you.
