I asked the employee if she has legal guardianship over her sister and she stated it will be sometime next year (jan-mar) So until she can provide me with that documentation she would not be eligible for FMLA, right? Sorry if I am not "getting it" …

Do you have a policy that states if they are a no call - no show for so many days then there employement is terminated? Even if he is in a re-hab - it is his responsibility to notify his employer. What did you say in the letter?
