Congratulations!

I haven't been as active as I'd like, either. I've taken an operational-side job so I don't have a good excuse to be playing around in here during working hours. To make matters worse, the performance of these forums has just been atrocious lately…

Everyone -- I appreciate your kind words. There are some very talented people here and you cannot go wrong asking a question in these forums although it is often best to wait a few days before acting if you can just to get different perspectives. …

This is a case of "do the right thing." The Company did not make good on it's promise to give her milestone feedback and direction on a monthly basis, which could be part if not the very basis of her failure to perform. You should extend the peri…

Child support docs can be in the EE file. I-9s CAN be in the employee file but there are a lot of good reasons why they shouldn't be. Among them are issues like getting all the I-9s back out of the employee files before the auditors show up after t…
Training documentation should be kept in a seperate folder as well. I am in Ohio but I believe that is standard.
That's standard -- line supervisors need to know who can be assigned to what but they don't need to …

It should be the temp agency's problem but there should also be no problem with them providing you with a letter statng that the temp is their employee and that they have complied with all requisite laws specifically including IRCA as amended.

Employee count, pls? With or without payroll? Featured and benefits you are specifically looking for?
If you have a doctor's note that puts someone on light duty you need to follow those instructions or send the person to the doctor to get released. Even if you end up paying for that doctor's visit you need to do this. If not yo…

Our payroll coordinator has not been through the ADP training but is getting along well on her computer knowledge and payroll experience with other systems. She needed to remove an insurance deduction from someone's payroll. It took her 5 calls, i…

I've recently changed companies and we use ADP where I am now. Terrible reporting power. Very inefficient to use with layer upon layer of screens and menus that don't seem necessary. Ceridian isn't great in this regard but ADP is worse.

When I was in training for Ceridian, 2 of the 8 companies represented there were changing from ADP because ADP made serious errors in their 401(k) administration. ADP presented a higher bid than Ceridian each time we went to them over 4 years of lo…

OFCCP compliance with what, exactly? The AAP cannot specify anything more than the company's plan to ensure that it is recruiting from a sufficiently wide array of sources to get a diverse array of qualified applicants. The most they can do is que…

The EEO-1 Report is a report of head count broken down by job type (very broad based categories), by sex, by race. It's an EEOC report, not a DOL report. I read an article about it a few years ago essentially saying that the report cannot be used t…

I think Non Competes are in trouble in the 5th circuit. They're viewed as anti-competitive.

The prospective employee cannot sign a document that creates obligations for your Company, although he could sign one saying that he is obligated to have your Company sign something before hiring him but that would not create obligatinos for your CO…

Technically, the law says that you may not consider race or sex in employment decisions. Therefore, you will need to have your spiel down on what, exactly, you mean by "affirmative action candidates". It could be the case that you are simply creat…

What will make your job board any more interesting or successful for applicants or employers compared to what is already out there?

A person who is not an employee is not eligible for FMLA. The Company may, out of a big heart, extend 3 months of benefits and a right to reinstatement even those she has resigned but that sets one heck of a precedence for other employees. I would…

As a general rule, I try to have any department carry a process from cradle to grave. They made it, they distribute it.
OK, I have an employee complaint for you which I am not sure how to handle! We've had numerous complaints about an employee who wears to much perfume. Fellow employees who work in her office area are complaining of gettin…
You mentioned the coffee mug and bumper stickers. Is an employee saying they are offended by what is on these items? A few more details will help us to give you some advice on how to handle this.
Bingo. This is a cas…

Applications submitted to your company are proprietary documents that belong to the company. If you are a public employer, there may be FOIA issues.

Alternatively, test all 6 and the foreman. Your biggest concern will be unemployment rather than any sense of anybody being singled out. Whatever else you do, get your drug free workplace policy published and include the policy stating the compan…

You betcha.

Red, we dumped our personal leave policy and cover everything under FMLA and other forms of required leave in conjunction with our generous no-fault attendance policy. We term and rehire people who need leave outside of that regimen. If that does…

Stromberg makes great products. Paychex is inferior to other products out there, particularly on the HRIS side. As a non-web product, it has a significant cost to purchase and ongoing cost of ownership. If you don't have extra IT on hand, factor …
Well that is pretty plain. I appreciate the response. [Y]
She's good at that. :-)

If you do a RIF and hire another person into the same position, you will be setting yourself up for a pretext case. This will be substantially remedied if the employee will admit in writing that they can't do everything in the job description and i…
