Nerve damage sounds like an ADA issue, but since we are not doctors we cannot really make that call. Your best bet is to begin the interactive process and just ask her what it would take to get her back to work. If you can accomodate her, t…

ADA works differently than FMLA. You need to talk to the employee and find out when she expects to return. If you can accomodate her some way without causing too much hardship on the company, then you should do it. For instance, if she needs anot…

We went through a similar transition more than 10 years ago; our change date was October 31st. We paid out all vacation time and began accruing anew (with original hire dates as our basis) under a slightly changed leave plan when we made the change…

Uh Frank, didn't you also want to tell us that though it was two men there was a female at the bottom of it?

I agree with everything Paul said except the part about it being personal and private. In some cases, it is a good idea to annouce recognition to the entire organization. For one thing, some employees like to be recognized publicly. But the main …
And this is work related, how?
I sure wish I had thought of this one yesterday when I had a complaint about grass being thrown by the mowers (40 feet away) and sticking to someone's car. All I could say was to catch m…

Let me think about that and get back with you.

Welcome to the Forum! Once they have the surgery, they have a serious medical condition. Even if getting there is their choice, it works the same as someone who deliberately takes some other risk (ie sky diving or some other action that causes the…

I think your colleague is wrong, but it depends on your state law. He/she may be confused because you can run work comp time and fmla time together. However, prior fmla time and work comp time do not count towards the 1250 hours. Only time worked…

Welcome to the forum! This is not federally mandated, but you might have it in a state law or union agreement. It also may already be a part of your policies or past best practices. (If you have a history of advertising, but don't do it on this o…

I would not do anything other than what you are currently doing. As you said, there is nothing in her files. If you tried to tell her now she will never be hired then she may find grounds to sue. I would just keep sending her the letter. Eventua…

If she is she will soon find herself out of luck. The job level for the employee who retired is considerably lower than the current employee's level. If we start adjusting for the 'additional' work, we will have to reduce her pay.

I think her problem was that the new duties did not fall under her education, experience and licensing. She wanted to be given credit for the 'extra' work outside of her normal duties that she was doing. We are looking at a possible name change th…

Technically, yes. The other similar one is for an on-call person. I have removed a few of the requirements for the on-call person. We are so small that I think I only have one JD that is shared by two people. Everyone else has their own.

I am not sure. She did mention another part time employee, but that employee has a slightly different title (as I explained it to her). I am wondering if it is the work itself. It is something quite different from her regular job. Her regular jo…

I can see both sides of this argument. On the one hand, the employee obviously knew there was a problem and should have been budgeting accordingly (not spending the money they knew should go for insurance). The company is spreading the payback ove…

Ok. Now I know when I should visit you if I want to make sure I get to go Taffying. You'll take me, right?

There are questions you have to ask before you can decide how best to handle moving expenses. Here is a link to a good article on it: http://www.payroll-taxes.com/articles/art_moving_fringe.html

The situation has changed. Get a new certification.

Our investment committee is the Presiden/CEO, me and a board member (though the board member never attends any meetings), and we have between 20 and 25 participants. Your committee should have 2-3 people, and they should be people who really unders…

Did you hear they found the Cobra snake that was missing from the Bronx zoo? They found it in Lindsay Lohan's purse. I am so vewwy bad. I hate myself.

As long as you have documentation that you were going to take action BEFORE he requested FMLA, you should be completely in the clear. Good luck!

My mind was wondering this morning (no comments please!) and I was remembering my great-grandmother. Her name was Winifred. In private, my sister and I referred to her as Wini, so we would always know which grandmother we were talking about. I go…

Hmmm. I have been thinking. Maybe I should just come up with some kind of 'Super Star' statue/award that I can use for different things. Right now it can be used for our Biggest Loser, but later it could be used for something else. SS. hmmm. P…

The best one is the Chubby, but you are right, that probably won't send the right message. I thought about making it the Wacky Weekly Weight Loss Award, and calling it the Wacko. Somehow, that one doesn't fit either.

First, is your organization large enough for FMLA (federal or state), and does she qualify? If so, do you have all the paperwork and processes complete? You said she is on disability. Does she qualify for ADAAA, and if so, have you started the int…

HR conducts investigation here, sometimes with management input (depending on the circumstances). The only time management would conduct the investigation here is if the complaint was made against HR (me). So far, so good.
