I can't begin to imagine how you would go about requiring an employee not to smoke. I don't think you can make a person stop performing a legal activity so long as they don't do it in a restricted area, or on company time.

You might want to check with your state's Department of Labor, I found all the statutes posted my state's DOL website. If the web option isn't available, just give them a call.

MN law allows an ex-employee a copy of everything contained in the employee file within one year of termination. You might want to check with your state's DOL. I accessed the MN State statute through the MN DOL website. x:D
