This is such a tender topic, and I sympathize. I was horrified to read the indiscretions, but at the same time it takes someone with a lot of discipline to work in HR, and not everyone is cut out for it. I've been in many situations where gossip an…

you mean someone in a position of authority is arguing with you over keeping personnel files under lock and key? Woah. This person doesn't have enough to do. This seems like such a no-brainer. Maybe HIPAA is your best bet. Unless you have enough…

This makes sense to me but I'm having a hard time picturing the timesheet. Let's assume the employee is non-exempt. If you report hours on a daily basis, in the above example you have a 10-hour day where only 8 hours holiday pay is applied. What …

Another good idea, Marc, thanks. You put your finger on another concern. I keep wanting to divorce some of this from performance, which is why I like Shirley's solution.
-
Thanks, Shirley, you have addressed the part of this question that was troubling me, how to correct the inequitable salary. I wasn't asking folks whether attendance was a part of performance, whether to give him a performance raise on its own, or ho…

I agree with this approach, Lisa, thanks. You and Brother Bluto are right about being careful not to create an implied contract or expectation for what happens going forward.
-
WT. I agree with you but this is not a performance pay raise. It's an equity adjustment because in our assessment he is earning less than the position is worth given the new duties he has taken on and the trouble we had hiring a comparable person a…

Thanks, all for your comments. the right thing to do was to grant it, which I did.

Nice capsule, Paul. Thanks.

This is a fascinating discussion, but I must say I feel like such a novice. I'm no HR or online neophyte, but I have never been to Myspace.com or it's comparables. Part of me can't wait to get over there, the other part says "stay away lest you fi…

P.S. I would indeed like to receive a copy of your contract. I sent you my fax number via private message to your HR Hero mailbox. Thanks.

Nevada HR, this actually brings up another question. Does HIPAA regulate this sort of doctor-employer-emploee relationship?
-
Just to report back on where things are now, I have asked the EE to have her doctor weigh in on this, in writing, and have put her on paid leave until I receive the document, which will take a couple of days. I stopped short of saying "have your …

Thanks for your comments. This person is a recent and casual friend, someone who's been out of work for a while for reasons out of her control as far as I can tell. Your questions regarding working together are good ones I should think about, but …

Okay, here is a new twist to this story. We have decided to relocate this person, and may even wind up sending her home, but that's a different matter. My question now has to do with her replacement. I have two options, one is to go through a temp…

Thanks, I did know what you meant, and in fact under a separate thread I asked for advice on how to establish a relationship with an external doctor's office for this purpose. You have supplied some helpful info in your post, however, and as well h…

Thanks, Bro. We don't have a company doctor, would there be any problem in asking for an opinion from the employee's doctor? Obviously the outcome is more likely to be pro-employee but I supposed we could get a second opinion at the point at which…

Paul, you clearly were so dazzled by my entertaining pseudonym that you missed the fact that the construction will last another six weeks or so. x:D

Thanks, Paul! I've bookmarked this for a closer look.

Cali, we are not unionized. I think Sybill is only bringing up the idea because the person I did allow to have a rep is her best friend in the organization. Sybill is one who latches on to any idea if she thinks it will help her. However, I think…

NaeNae, I could have written this post but substituted Massachusetts for Kansas. We have run into problems several times with tax laws regarding treatment of domestic partner health plan EE premiums and then with treatment of HSAs, and in both case…

Parabeagle, I'm interested in your "make your life miserable" comment. Do you mean repeated phone calls? I can withstand those if I'm on solid legal ground to refuse (and have a call in to my lawyer on this) but obviously i don't want to break th…

Hmm. The form letter I got has no signature anywhere, and the only reference to the employee is in a typed section at the top. It's not even signed by an authorized representative of the agency, there's a 5 digit code on that signature line.

E, thanks for the follow up. It was very informative. How large is your company, how many employees or FTEs? That's a drag about the multiple audits, and scary if you've got an angry ex-employee (or current?) on a campaign that last 18 months... …

Thanks, TN, I am indeed asking about the supervision part. We have a lot of what you describe in place for folks (including IT) who work from home after normal business hours, on the weekends, or while travelling. The question has to do with antic…

We don't have anything in place so I'm very interested in this thread. I wonder if during an emergency the 911 operator is qualified to coach in use of defibrillator or other action steps, or if they can patch you through to an EMT? It is so true …

Thanks, that's very helpful. Carol

No, you are right, there are many times I coach employees on how to approach supervisors or reoslve conflicts with co-workers. It's just handling the formal grievance in compliance with our grievance procedures that has me stumped.
-
Geno, I like your arguments but find it hard to envision. Can you give me an example of under what circumstance you might assist an employee in writing a grievance? The only way I could see it working here would be if I were to recuse myself from…

Crout, this really made me stop and think. I would not want to be in the position of working with lifelong friends, I must say. People would probably assume they had my ear and I theirs, and heaven help their subordinate who came to me for counsel…
