Simple Assault Charge

We are a long-term care organization in a state requiring background checks to aid in the protection of the elderly. A recent new hire's background check came back clean, however, just recently he was charged with simple assault by shoving an individual and then hitting him on the back of the head several times while he was down. The employee was released on bail. Because he has not officially been charged with an offense yet, must be keep him employed?

"To fire or not to fire: Remember arrested employee may not be guilty"
DMK, here are some thoughts on firing employees who have been arrested and accused of a criminal act. It quotes employment law attorneys from four states (South Carolina, Utah, Vermont, and West Virginia). Hope this helps. tk
