Marital Status

My company is switching insurance carriers. We have a few employee's spouses that have chosen to keep their maiden names. The insurance company wants to know why they have a different last name than the covered employee. Is it legal for me to request this information from the employee or should this be something the insurance company handles?

why would the insurer care why they chose to keep the names they were born with? a lot of people do this. i don't see the point of asking why. are you asking if the insurer can request proof of marital status?

The insurance Company can request a copy of the marriage license or other evidence of marriage, same name or not. At least they can in any state I've worked in, which does not include CA.
