  Here are the states that have passed laws about this:

  Arizona, Colorado, Georgia, Illinois, Minnesota, Mississippi, Missouri, North Carolina, Oklahoma, Rhode Island, South Carolina, Tennessee, and Utah.

  Some of these states don't go into effect until 1/1/2009. Here is a website I found that gives more information on whether all employers need to do this or just employers with state government contracts:
