In Louisiana, unused earned time for paid vacation must be paid at termination.

We have a use it or lose it policy (our fiscal year is 10/1 - 9/30) with a carryover to 12/31 based on extenuating circumstances. Upon termination we pay out only accrued time. Just making sure that was A-Ok in the State of Florida.
I think in Florida, wages include all forms of remuneration for an employee's services, based on time worked or production output. So, if vacation pay is promised by an employer practice or policy, it is included in the definition of wages. Then, if an employee leaves the payroll, the person's accrued, unused vacation should be compensated according to the employer's accrual plan -- I don't think that unaccrued vacation would be included.
