Cobra under court ordered coverage of dependant

We have an employee whose child was covered through a court order under our plan. the employee was recently terminated. I have sent him Cobra forms, do I need to send the ex-spouse forms too? She is the custodial parent.

I don't know if it is required or not, but I definitely think it's the "right thing" to do. All too frequently I assist employees whose ex-spouses have lost insurance for their children and not told them. In once case, the employee's daughter was in a serious auto accident and they discovered she had been uninsured for nearly 5 months. It has financially ruined this employee.

If you have knowledge that the dependent lives at a different address than the employee, you have a responsibility to send separate COBRA notification to that address. The address of the custodial parent or the child support office should be on the notice itself.

I have had to do this on numerous occasions.
