Wasp Stings?

I believe the answer to this will be that we are not responsible, however I just want to double check. I have an employee who was training on how to take care of the swimming pool. EE put his hand on the fence and a wasp stung him (he is allergic). Is this a workers comp. issue??

This would be compensable in WI if they were on the clock.

Of course it's a comp issue. It's a hazard of the job. The employer does not have to provide the wasp nest for a worker to be covered if he's on duty. Nor does the employer have to be negligent. I have another one for you to get ready for 'T'. Sunburn is also a comp issue.

That is amazing! I guess we learn something everyday. And now sunburns too, my ee's better be wearing sunscreen or we'll term for failure to follow safety regs. Although termed or not the ee has already got the claim. How unfortunate!

In Texas, something like that would probably be covered only if the employees job put them at greater risk than the average person.

So if someone who normally works inside happened to walk outside to give someone a message, etc. it wouldn't be compensable.

However, if the person's job involves lifeguard, playground monitoring, etc. it should be compensable - they have become at greater risk due to their job.
