FMLA & Public Employers

I understand that all public employers are covered by FMLA. However, when it talks about which employees are covered it says that they have to work at a site with 50 employees within 75 miles. Since we only have 32 employees, this means our agency is covered but our employees aren't. Correct? If so, what exactly does this mean and why do they bother differentiating between private and public employers? Thanks in advance for any clarifications!

  • Congree in its wisdom decided that public agencies are covered regardless of the number of employees but for an individual to be covered that individual needs to meet the requirements of the regulations including working at a worksite where 50 or more employees are employed within 75 miles. Why this rule? Ask Congress.
