We have many boxes of old files that have been stored and we want to dispose of the ones that are more than 3 years old. Is there a preferred method for record destruction and is there any legal requirements regarding destruction?

rroberts: Just make sure you've exhausted all the retention guidelines set forth by FLSA, ERISA, IRC, HIPAA, Title VII, EEOC, OSHA and so on. The retention periods vary from 2 to 6 years, sometimes on the same document. If you'd like a good guide for that, please e-mail me and I'd be happy to forward it your way.

Greatly appreciated. Oh, and by the way, if there are records about exposure levels employees were subjected to under OSHA standards, those only need to be kept a mere 30 years. (like we'll even live that long)

We have a local company that travels around to businesses and shred their old documents. The cost was reasonable and they use equipment much more powerful than your standard shredder - it will even take standard staples. Check your yellow pages to see if there is someone in your area that provides the same service.
