Holiday Pay while on unpaid leave

How do you handle employees who are out on unpaid leave if a paid company holiday occurs during that time? Do they receive holiday pay? Our employees receive holiday pay if they are out on paid leave (meaning they are using their accrued sick a/o vacation time) but now the question has come up if the ee is on "unpaid" leave. How do you handle this?

If they worked during any portion of the pay period that the holiday fell & the unpaid leave began, then we pay the holiday. Be careful though - if it's FMLA - you have to pay....

do you really have to pay holiday pay if someone is on FMLA leave or is that just your policy? I don't remember ever seeing that anywhere.

assuming your policy does not address the issue, you decide whether being on unpaid leave quaifies an employee for holiday pay. for example: does an employee on unpaid qualify for any other paid benefit such as bereavement leave. bottom line: it's your call.

To trigger holiday pay in our company, an employee must work his/her last scheduled shift prior to the holiday and his/her first scheduled shift after the holiday in order to receive the pay.
