If an hourly employee's hours are 7am to 3 pm and he or she gets hurt on the job at about 9am and has to go to the doctor for stitches and the doctor sends him home for the rest of the day....do we as a company pay for the rest of the day?? Please help as soon as possible. Thanks in advance.

If your organization permits partial day pay for non-work related illnesses, then you're probably looking at doing the same for this employee. Secondly, your state likely has a waiting period b/4 w/comp comes into play, so even if the injury is compensable under IN law, there's likely a 2-3 day waiting period b/4 w/comp applies. Depending on the seriousness of the injury, the employee could be entitled to lost time payments for the day of injury, but will probably have to be off work for 10-14 days b/4 this is applicable. Most employers permit some form of sick time payment for the situation you describe. Hope this helps.........not a simple answer when work comp is involved.

If hurt at work, and the company doctor sent them home, I have always paid them for the day of the injury.

We also pay for the remainder of the day of the injury, but it is by company policy, not law. Check your state WC law, but you probably don't have to pay. We also allow employees to use sick time for the three day waiting period in WI, but not until the following pay period to see if the lost time is going to extend beyond seven days, in which case WC goes back and picks up the three day waiting period.

By our policy, they can use sick or vacation time but we don't pick it up.

Be sure you check your WC state law. Some states require that you pay the employee for the rest of the first day.
