I-9 QUESTION-- REALLY NEED HELP!!!!

How long should I-9's be kept on file for current/active employees? How often should the employee fill out a new i-9?

The I-9 should be kept for a minimum of three years or one year after the date that their employment ends. Under the third part of the I-9 form, if the employee's work authorization documents have an expiration date, than you must reverify eligibility before that expiration date.

Do they have to fill out a new one if they have a name or address change?

With a name change, you can either have them fill out a new one, or complete the third part of the form. Make sure that you see the proper documentation to go with the name change.

You do not need a new I-9 for a change of address.

Once I read this post regarding name change, I went back to Immigration's website to find this requirement. I was unable to find it. The only information regarding a name change was linked with the expiration of a document and it needed to be verified.

If you can explain to me why a name change would initiate the I-9 form to be updated I would appreciate it. I just don't see the link between verfifying an employee's authorization to work in the U.S. when they are first employed with updating the I-9 form if they get married with no expiration of documents occuring, especially if the person is a U.S. citizen and documents provided were the SS# and driver's license.

A non-citizen (except for diplomats and diplomatic workers on A or G visas)whose address changes must complete an AR-11 form within 10 days of the change or face possible deportation and criminal penalties. This law has been around a while but was never enforced. Times have changed, however, since Sept. 11.
